A Lasting Power of Attorney is a legal document that appoints someone else to deal with your financial affairs or make health decisions, if you are physically or mentally incapable of dealing with your own affairs.
You can appoint up to four Attorneys and a further four replacement Attorneys if necessary. The Attorneys must be over the age of 18 years and have full mental capacity.
Before your Attorneys can act for you, an application has to be made to the Office of the Public Guardian to register your Lasting Power of Attorney. The registration process can take up to 20 weeks to be processed.
When your registered Lasting Power of Attorney is returned, it will show a validation stamp. A copy of the registered document can then be produced either physically or electronically, to each financial institution that you have dealings with. The financial institution will ask the Attorneys to prove who they are for money laundering purposes, and they will then register the Lasting Power of Attorney on their system. Your Attorneys will then be able to act on your behalf in dealing with your financial affairs.
Victoria Law Solicitors are experienced in drafting Lasting Powers of Attorney and are happy to take you through the process from start to finish. An initial meeting will enable us to explain the two types of Lasting Powers of Attorney to you, take your instructions, provide you with drafts for approval and you will then be invited to a second meeting to support the execution of the document.
As members of the Society of Trusts and Estates Practitioners (STEP) we are specialists in the field of Lasting Powers of Attorney so you can feel comfortable in the process from start to finish.
